The GoMetro Survey app is a product developed and supported by GoMetro (Pty) Ltd.
Any reference to the word “App” in this document refers to the GoMetro Survey mobile application.
THE USE OF THE APP INDICATES THAT THE USER HAS BOTH READ AND AGREED TO THE TERMS AND CONDITIONS DESCRIBED IN THIS DOCUMENT. NO-ONE MAY MAKE USE OF THE APP UNLESS ALL TERMS AND CONDITIONS DESCRIBED HEREIN ARE ACCEPTED BY THE USER. ALL SECTIONS OF THIS POLICY ARE APPLICABLE TO APP USERS UNLESS THE SECTION EXPRESSLY STATES OTHERWISE.
1.1. The GoMetro Survey app is a mobile application that is used to collect demographic survey information, as well as track movements and modes of transport of its users (the “Data”) for a set period of time. Users locations and modes of transport are only tracked after having provided their explicit permission to do so in the App.
1.2. The App can be used in multiple cities or regions and the user indicates which city or region they will be allowing their Data to be collected during the tracking period the first time they open the App. The Data collected is anonymised within the App and send to a central portal to be aggregated with other users’ Data in order to generate useful transport metric for town and fleet planners to use.
1.3. In order to incentivise users to use the App, some cities or regions (the “organisers”) will incentivise the user to use the App for a set number of days (e.g. 7 days), and ask the user to check that the Data captured is accurate by using functionality within the App. Such incentives will be offered in the form of a specific prize offered, whereby the user’s mobile number will be entered into a periodic draw, typically weekly or monthly, that will be undertaken on behalf of the city or region by the App operators.
1.4. Where an incentive is offered, the prize available will be described to the user, as well as the draw period.
1.5. In order to the enter such a draw, at the end of a tracking period, the user will be asked to provide their mobile number to be added to the draw. The decision to provide their mobile number is entirely up to the user. If the user does not provide their mobile number when asked, they will not be entered into the draw.
1.6. Each incentive is funded and provided by the city or regional representatives associated with the survey project for their area. The App provider is not responsible for the provision of any incentives to the user.
1.7. Any user of the App is eligible for an incentive offered for the city or region they select. However if the incentive is specific to the city or region, any user that may win such a prize, it is up to that user to be present in the city or region in order to take possession of the prize or its use.
1.8. There will only be one draw per incentive period per city or region.
1.9. Each incentive is only available for the period that the App is made available in the city or region selected by the user when first using the App. Any entries received after the city or region is no longer running the Survey App will not be considered for an incentive draw.
1.10. Incentives are open to all persons who are 18 years or older
1.11. Employees, directors and agents of the city or regional representatives that offer incentives, their immediate families, life partners, business partners and associates and any person directly involved with the sponsoring, devising, production, management or marketing of such incentives are not eligible to participate in any draws for prizes.
1.12. The incentives are not open for entry by or on behalf of a legal entity. Entries received from business accounts held by legal persons are excluded from participating and benefitting from any incentive draws.
2. Incentive Mechanics
2.1. To enter an incentive draw for a prize, the following steps must be performed
2.1.1. The person must download the GoMetro Survey app from either the Apple App Store or Google Play Store and install it onto their mobile phone. Tablets are excluded.
2.1.2. Once installed, the user must run the App, and select one of the cities or regions shown to them in the App in the first screen. Once a particular city or region has been selected, the user must progress through the information screens, which will explain how the App works, the incentive (if any) offered, the draw period and the number of tracking days that the user must allow the App for in order to be entered for the draw.
2.1.3. The user will answer the general demographic survey in the App, and then provide permission to allow their location and activity (mode of transport) to be detected by the App during the tracking period. The user will be required to set their location permission to “All the time” in order for the tracking to occur throughout the period.
2.1.4. Each day, the user should open the App and view their trips detected in the previous 24 hours (or before that). In each case, the user should view their trips and indicate whether the route shown is accurate or not, as well that their primary mode of transport (e.g. walk, train, bus etc.) and general travel purpose (e.g. work, education, shopping, errand etc.).
2.1.6. At each draw period, the App operators will group all mobile numbers provided by users, as described above, and randomly draw a winner for incentive offered. The prize winner mobile number will be provided to the city or regional authority providing the prize to contact the relevant winner.
3. General Terms and Conditions
3.1. The incentives are valid for the period in each city or region based on when each cities or regions decide to make it available.
3.2.There are no additional charges for participating in the Competition.
3.3.Participants are only allowed to enter once, multiple entries will not be considered and the first entry from the participant will be valid only.
3.4. Any prize is not exchangeable for cash, and will not be transferable or negotiable.
3.5.The city or region offering incentive prizes reserve the right to substitute the prize for an alternative one of equal or greater value should the prize not be available for whatsoever reason.
3.6. Participants acknowledge that any personal information supplied for purposes of accepting prizes is provided voluntarily.
3.7. User data collected for the purpose of drawing a winner or providing the prizes to a winner will not be used for any other purpose other than for the provision of such prizes only.
3.9. All risks and ownership of prizes shall pass to the successful person whose mobile number is drawn on transfer/delivery thereof and all of the organiser’s obligations in regard to the incentive, as well as in regard to the prize shall terminate. The organisers or App operators will not be held liable for any incorrect cell phone number provided by the drawn winner.
3.10. Notwithstanding the fact that the prize vests on the successful drawn winner immediately upon the determination of the results, any prize that remains unclaimed/ undeliverable after a month of transfer or no reasonable effort is made on the part of the successful winner to claim the prize, despite having been advised of the results of the draw, will be forfeited.
3.11. In the event of a dispute in regard to any aspect of the incentive, draw and/or the Terms and Conditions, the organisers decision will be final and binding and no correspondence will be entered into.
3.12. The App operators and/or city and./or regional organisers are not liable for any technical failures affecting participation in the incentive draw.
3.19. Neither the App operators, the city or regional organisers, nor any other person or party associated with the incentive, their associated companies, agents, contractors and sponsors and any of its personnel involved, shall be liable whatsoever for any loss or damage incurred or suffered (including but not limited to direct or indirect or consequential loss), death or personal injury suffered or sustained arising from either participation in the incentive draw or from claiming the prize or after claiming the prize.
3.20. The organisers reserve the right to extend, reasonably shorten or suspend the time period of the draw period for technical or commercial or operational reasons or for the greater public good or due to a “force majeure” event or generally for any reason whatsoever within its sole discretion, on condition that it notifies the participants in a manner that is expedient according to its best ability.
3.21. The App operator or organisers reserve the right to amend the rules and/or terminate this incentive program immediately at any stage, whether required as a result of changes in legislation, or if required by any national, provincial or municipal authority, or within the sole discretion of the organisers for any reason (recognized in law). In such event, all participants waive any rights that they may have/purport to have in terms of this incentive offer, and acknowledge that they will have no recourse against the App operator or organisers whatsoever.
3.22. All participants indemnify the App operator and organisers, its associated and subsidiary companies, and its directors, officers and employees, against any and all claims for any loss or damages, whether direct, indirect, consequential or otherwise, arising from any cause whatsoever from their participation in any way whatsoever in this incentive program.
3.23. All information relating to the incentive program which is published on any marketing material will form part of these Terms and Conditions. In the event of any conflict between such marketing material and these Terms and Conditions, these Terms and Conditions shall prevail.
