Terms and Conditions

1. Promotion Overview:

1.1. This PTU Performance Guarantee (“Promotion”) is offered by GoMetro (Pty) Ltd (“Company”) to customers who purchase PTUs (Platform Tracking Units) during the promotion period as specified in Section 2.

2. Promotion Period:

2.1. The Promotion is valid for purchases of PTUs made from 1 November 2023 to 31 January 2024 (“Promotion Period”).

3. Performance Guarantee:

3.1. The Performance Guarantee ensures that PTUs conform to the agreed-upon performance standards discussed prior to the sale. These performance standards include the following key success factors:
a. The device should update on the Platform as specified.
b. Updates should occur at the agreed-upon time intervals.
c. The battery life of the device should meet the timeframe agreed upon pre-sale.

4. Guarantee Terms:

4.1. If a PTU purchased during the Promotion Period does not meet the specified key success factors as outlined in Section 3, the customer is entitled to receive a refund of 50% of the purchase price. This refund will be processed in accordance with the procedures outlined in Section 5.

5. Refund Process:

5.1. To request a refund under the Performance Guarantee, the customer must provide written notice (email to sales@gometroapp.com) to the Company within 7 days days of discovering the non-conformance with the key success factors.
5.2. The notice should include:
a. Details of the specific non-conformance.
b. Proof of purchase.
c. Any additional information or documentation that may be required by the Company.
5.3. Upon receipt of the customer’s request, the Company will review the claim and may request additional information or perform testing to verify the non-conformance.
5.4. If the Company determines that the non-conformance is valid, a refund of 50% of the purchase price will be processed within 14 days of the validation.

6. Limitation of Liability:

6.1. The Company’s liability is strictly limited to the terms outlined in this Promotion. In no event shall the Company be liable for any incidental, consequential, or special damages, including but not limited to lost profits or data, arising out of or in connection with this Promotion.

7. Warranty:

7.1. The standard warranty for PTUs applies to all purchases made during the Promotion Period. The warranty terms and conditions are as specified in the standard warranty agreement provided with the product.

8. Governing Law:

8.1. This Promotion and its terms and conditions are governed by the laws of the Republic of South Africa, and any disputes related to this Promotion shall be subject to the exclusive jurisdiction of the courts in the Republic South Africa.

10. Modification and Termination:

10.1. The Company reserves the right to modify or terminate this Promotion at any time without prior notice. Modifications or terminations will not affect the rights of customers who have already purchased PTUs during the Promotion Period. Modifications will be published on our website.
