The GoMetro Survey app is a product developed and supported by GoMetro (Pty) Ltd.
Any reference to the word “App” in this document refers to the GoMetro Survey mobile application.
THE USE OF THE APP INDICATES THAT THE USER HAS BOTH READ AND AGREED TO THE TERMS OF THIS PRIVACY POLICY. NO-ONE CAN MAKE USE OF THE APP UNLESS ALL TERMS OF THIS POLICY ARE ACCEPTED BY THE USER. ALL SECTIONS OF THIS POLICY ARE APPLICABLE TO APP USERS UNLESS THE SECTION EXPRESSLY STATES OTHERWISE.
1. Privacy Policy
1.1. For the purposes of this section, Personal Information is defined under the GDPR (General Data Protection Regulation) definition under Article 4.1. We also subscribe to the principles for processing any personal information as outlined in the GDPR. We endeavour to ensure the quality, accuracy and confidentiality of Personal Information in our possession.
1.2. In adopting this Privacy Policy, we wish to balance our legitimate business interests and your reasonable expectation of privacy. Accordingly, we will take all reasonable steps to prevent unauthorised access to, or disclosure of your Personal Information. However, it is impossible to guarantee that your Personal Information shall be entirely secure.
1.3. The use of the App is intended to enable transport planners, including city, regional or country-wide planners, and/or providers of transport fleets including public transport, cargo or taxi fleets to get aggregated travel data analytics and patterns in order for them to make public and commercial decision relating to their transport-related decisions.
1.4 In order to aggregate data, individual users of the App are asked for explicit permission to allow the App to track their movements and activities detected by their mobile device for a set period (e.g. 14 days). During the course of the tracking period, at no time, does the App request or require the user to provide any explicit identifiable personal details such as names, any identification number or similar.
1.5 During the tracking period, and only once the user has provided explicit permission to do so, the user agrees that the App may collect the following data:
- Location of the user
- Timestamp of the location position
- Activity of the user as reported by the operating system e.g. walking, cycling, in- vehicle
- Generic demographic survey data including within various age ranges, income level ranges, educational level ranges, gender (including the ability to not select a particular gender), and if any physical disabilities exist.
- The city or region name where the user will be predominantly based during tracking period.
1.6 At the end of the tracking period, in some versions of the App, the user will be offered an opportunity to enter a draw for a prize specified by the promoter of the App within a particular area (e.g. for a specific city). If the user wishes to enter the draw where a prize will be drawn, the user will need to provide a mobile phone number, which will be used solely to inform the user if they win the prize draw, but will not be used for any other processing related to the locations tracked. The user is not obliged to provide their mobile number and can choose to skip entry for the prize draw.
1.7 Within 24 hours of collecting any locations, the user of the App will be able to view the locations collected from the previous day and previous tracking days. and view the approximate route of their trips on a map. The App will request the user to indicate whether the route for each trip is accurately indicated or not.
1.8 In order to collect tracking data that can be aggregated with other such data to determine travel patterns for transport planners, the App must be able to continue to track user locations, even when the user is not using the App. This is called background location tracking, and the user will be asked to explicitly enable such location permission on their mobile phone to allow tracking “all- the-time” in order for such tracking to occur in the background on their mobile phone, which will then be limited only to the tracking period.
1.9 At the end of the tracking period, the App will automatically turn off the tracking within the App. The user does not need to actively turn off the tracking at the end of this period. Once tracking has been turned off, the user will be able to confirm that such tracking is no longer active by viewing the tracking status displayed within the App.
1.10. The location and activity data collected by the App will be transferred to a central portal under an anonymous reference identifier. This ensures that it is not possible to link such data to a specific phone or person. The collected anonymous data is processed by the portal to determine travel-related metrics such as travel distance, travel times, modes of travel and generic purpose of travel. This data is then combined with other anonymous data from other user int eh same area or region, so that aggregate travel metrics and patterns can be determined. At all times the data is kept anonymous and within a secure system.
1.11. The App does not collect, use or disclose sensitive information except with your specific consent (as specified in Clause 1.5 and 1.6) or in the circumstances required by law.
1.12. By agreeing to the terms contained in this Privacy Policy, the user consents to the use of your Personal Information in relation to:
- Responding to any queries or requests the user may have
- Displaying the location data to the user within the App to request verification of its accuracy
- Aggregation of the anonymised data collected so that GoMetro, it’s commercial partners and related transport planners can view transport-related metrics and patterns
1.14. Communications between the App and the processing portal occurs over a secure communications connection with authentication required to be provided by the portal before such data will be accepted for processing.
1.15 The processing portal is hosted in a secure GDPR approved cloud-based data centre, where only limited access is available to a small group of system administrators. All initial, processed and aggregated data is stored within this data centre, with all data anonymised.
1.16 The aggregated data is only made available to GoMetro administrators and commercial partners for this project via secure access to a web-based portal for this purpose. There is no mechanism for using the aggregated data to trace any data back to any App user.
1.17. Although absolute security cannot be guaranteed when interacting via the Internet, we have in place up-to-date, reasonable technical and organisational security measures to protect your Personal Information against accidental or intentional manipulation, loss, misuse, destruction or against unauthorised disclosure or access to the information we process online.
1.18. While we cannot ensure or warrant the security of any Personal Information you provide us, we will continue to maintain and improve these security measures over time in line with legal and technological developments.
1.19. Your information will not be stored for longer than is necessary for the purposes described in this Privacy Policy or as required by applicable legislation.
1.11. The Personal Information we collect from individual App users shall only be accessed by our employees, representatives and consultants on a need-to-know basis, and subject to reasonable confidentiality obligations binding such persons.
1.12. We shall have the right, but shall not be obliged, to monitor or examine any of the Personal Information that is submitted by the App. The user alone determines whether such Personal information is submitted by controlling the Location and Activity permissions on their mobile phone devices running the App.
1.13. We constantly review our systems and data to ensure the best possible service to our users. We do not accept any users, or representatives of users, under 18 years of age or who otherwise do not have the relevant capacity to be bound by this Privacy Policy.
1.14. We will not sell, share, or rent your Personal Information to any third party or use your e-mail address for unsolicited contact. Any messages sent by us will only be in connection with the provision of the App services.
2. Log Files
2.1. When using the App, we may collect usage information, such as your IP address, the name of your ISP (Internet Service Provider), your browser, the device from which you visit us, the pages on our app that you visit and in what sequence, the date and length of your visit, and other information concerning your computer’s operating system, language settings, and broad demographic information. This information is aggregated and anonymised and cannot identify a user specifically.
2.2. The user acknowledges that this data may be able to be used to identify the user if it is aggregated with other Personal Information that you supply to us. This information is not shared with third parties and is used only within the company by system administrators to improve the performance of the App and associated portal. Any individually identifiable information related to this data will never be used in any way different to that stated above, without your explicit permission.
3. Links from the app
3.1. The App contains secure links to the data processing portal. Access to the data processing portal requires authentication built into the App.
3.2. Secure hyperlinks to this Privacy Policy page and the Terms and Conditions page for entry to any prize draws offered (when applicable) to users within the App.
4. Other
4.1. Data messages will be deemed to have been received by us if and when we respond to such Data messages.
4.2. Data messages sent by us to a user will be deemed to have been received by such user if the mechanism used to send such messages indicates that the message was successfully sent and/or received by a remote site associated with the recipient.
4.3. Users acknowledge that electronic signatures, encryption and/or authentication are not required for valid electronic communications between us and users.
